People who participate in the Quiz are confirming that they understand the terms and conditions and agree to be bound by them without reservation as a condition of participation.
Pre-defined Terms"Quiz" means a Quiz organised by InkRed
"Player" a participant in the Quiz
“PrizeClub” is a name collectively given to every Quiz game covered by these terms and conditions
“Prize” is a prize advertised in any medium which may be won
“Quiz Brand” means a Quiz that is categorised to encompass a particular type of prize
"Winner" means the person who correctly answered a question and was randomly selected by InkRed
Notice
These terms and conditions are effective from the 25th of September 2009. Any amendments that have been made to these terms and conditions that may effect or have an impact on people who have been participating in the Quiz before this date and who are still participating in the service after this date, will be sufficiently relayed to the same people in question.
Privacy Policy
This document outlines how the Quiz handles any data which may be associated with or identifies you in any manner. We encourage you to read it in conjunction with the Terms and Conditions of which the Privacy Policy forms a part. It is also your responsibility to review this Privacy Policy frequently as we may modify it at our discretion in your best interests and or under instruction from any relevant body pertaining to the retention of private data. Every time you visit the website or use the Service and provide us with information, by doing so you are accepting the policies and practices described in the Privacy Policy at that time.
Customer’s mobile phone number will be used to fulfil delivery of the service to in accordance with the Data Protection Acts 1988 and 2003, the European Communities Regulations 2003.

Description
By responding to PrizeClub advertising and the opportunity to win a prize, a player must correctly answer the question in the advertising or if there is no question in the advertising, the question sent by SMS, to have a chance of winning.
By answering a Quiz question correctly, participants earn a chance to win one of and/or all the prizes that are on offer at that time, not solely the prize that they have seen advertised.
All quizzes under the PrizeClub name are subscription services. The first question is free and thereafter each question received every 7 days will be charged at €4, or as indicated, irrespective of whether the question is answered or not. Only when a question is answered correctly will a player have earned a chance or increased their chances of wining a prize or prizes. There is no limit set on how many prizes an individual can win.
One must have a WAP enabled mobile phone in order to participate in the Quiz. Data charges may apply.
PrizeClub offers only one (1) free entry per mobile; not one free entry per Quiz Brand.
To unsubscribe from the service simply send STOP to 50150 (ROI) or reply with the word STOP.
Where winners of certain Quiz Brands are chosen, they may be given the opportunity to choose from all the prizes in that category that were advertised during a particular time period, which will be clearly outlined in the advertising. Players will always have the option to choose the prize that was advertised and to which they responded to. It is the winner’s choice.
Winner’s details will be posted on the services websites as soon as they become available.
General
Only persons aged 18 years or over may participate in the Quiz and must have the bill payer’s permission to play using a phone. Apart from the weekly subscription cost of €4 which provides a question, additional questions may be requested, each costing €2 per question. Proof of age may be required when claiming your prize. If you are unable to provide it, right is reserved to withhold the prize until such time as proof of age is supplied. If sufficient proof is not provided within the time limit outlined below for ‘claiming the prize’, the win and prize will be deemed void.
Persons who subscribe to the service may receive promotional messages from PrizeClub relating to the service and may also receive promotional messages relating to other InkRed services. To opt out of this promotional database please text the word STOP to 57052 (ROI).
The following are excluded from participating in PrizeClub and claiming prizes: Companies and individuals associated with InkRed, their immediate families, employees or persons directly supplying services in connection with a InkRed Quiz, their families and friends. The directors of InkRed reserve the right to withhold Items from individuals whom they have reasonable grounds to suspect may be in breach of the afore mentioned.
InkRed does not accept responsibility for equipment failures, power or network outages, premature termination of a call or text message whilst participating or trying to participate in PrizeClub whilst using a landline, mobile phone or website, or any other uncontrollable events. Claims for premature termination of a call/text message delivery during a Quiz will not be entertained.
InkRed reserves the right to alter, suspend or terminate the service at their discretion, and without prior notice. Participating in PrizeClub means acceptance of rules.
InkRed also reserves the right to prohibit any person from participating in PrizeClub.
InkRed will not entertain disputed answers to questions and the Company’s decision is final.
Players of PrizeClub and related games indemnify InkRed against any inaccurate information surrounding questions and/or answers.
In the event of a player noting an inaccuracy in a question and/or answer, InkRed will endeavour to clarify and amend the information as necessary.
Advertising material may contain inaccuracies and typographical errors. InkRed does not warrant the accuracy or completeness of the materials or the reliability of any advice, opinion, statement or other information displayed or distributed through the advertising. You acknowledge that any reliance on any such statement or information shall be at your sole risk. InkRed reserves the right in its sole discretion to correct any errors or omissions in any portion of advertising. InkRed may make any other changes to advertising, associated material and the service or pricing described in advertising at any time without notice.
Winners agree to allow InkRed to publish their details and photograph and agree to partake in any reasonable related press or media promotions. Winners must provide these details on request in order to claim any prize.
A winner is one who is randomly selected as a prize winner by an independent observer. Answering a question incorrectly does not result in an opportunity to be selected as a winner.
The first attempt to answer a question is Free. A phone is only entitled to one free PrizeClub question.
InkRed may at their discretion withdraw this promotion without notice at any given time.
Dates and times are taken from InkRed system clocks. No other time sources will be entertained.
You must be in possession of a phone to play PrizeClub. This phone must be registered in your name and you may be required to produce the relevant documentation in order to claim any winnings. If you are playing on a mobile phone that is not yours, you may be required to produce authorisation allowing you to use the mobile phone, from the bill payer of that phone in order to claim any prizes.
If you are playing with a pre-paid mobile phone, we advise that you register your mobile phone with your network before playing. You may be required to produce proof that the pre-paid mobile phone is registered. If it is not registered, prizes may be withheld and forfeited. See Mobile Phone Authentication below.
In the event that InkRed presents a winner with a cash prize and subsequently discovers that the winner is a Party excluded from claiming a prize, then the winner shall return the prize with interest at the rate of 4% over EUIBAR per annum from the date of payment by InkRed to the date of repayment by the winner. In a similar event where the prize is not a cash prize, the winner shall return the entire prize to InkRed in the same condition it was presented, or the cash market equivalent of the prize in question.
The Directors of the Quiz may refuse to give prizes or reclaim all prizes or sums paid to winners in the event that these prizes were obtained as a direct or indirect result of fraud, dishonesty or non-entitlement to participate in the Game under these Rules. This shall also apply to players who obtain prizes through unlawful, and/or unauthorized use of a telephone of which they are not the registered owners and/or bill payers. In special circumstances, if so requested by the relevant Network Operators, and/or by Regtel (ROI, or the country’s regulatory body), payment of prizes may be withheld pending the resolution of issues pertaining to unauthorized telephone usage.
In the event that InkRed deem in InkRed’s discretion, that the winner has correctly answered a question and become available for random selection as an InkRed winner by unfair means, using mechanical devices, or any means deemed unacceptable by InkRed, the winner’s participation will be declared void. All costs associated with this player’s participation in the Quiz are non-refundable by InkRed.
To the fullest extent permitted by law, the Directors of the Quiz reserve the right to amend the rules, change, or terminate the Quiz at any time, details of amendments, changes or termination, may be published and shall be applicable as from the date of such publication. In this context publication may also mean an audio message replacing the Quiz game on the premium rate telephone numbers or an SMS message facilitating public access to the service.
Participants in this service may receive text messages in the future, containing information regarding other services. If you do not wish to receive these free informational messages please contact InkRed and you will be removed from our database or email us at customer@prizeclub.ie. Details are not passed to third parties.

Prizes
InkRed may advertise multiple prizes simultaneously in multiple regions or countries. Quiz Brand winners may be given the option to choose which prize they wish to claim, which may or may not have been advertised in the winner’s region or country. For Quiz Brands that have duration of one month, the closing date will be the last date of that month and will be clearly displayed on all advertising. InkRed will randomly select at least one winner, more if advertised and at the discretion of InkRed, for that month, for as long as the service remains active, and shall do so no later than the end of the first week of the following month. For Quiz Brands that have time dependent prizes such as tickets and events, winners will be chosen the day after the closing date of the competition, which will be clearly displayed on all advertising.
There may also be prizes made available that have a longer duration than one month. This will be stated in any advertising.
InkRed, at their discretion, may also randomly choose winners of spot prizes which will be of various values, at any given time.
InkRed reserve the right to replace advertised items with a cash prize no less than the market value of the advertised item. Actual prizes may vary form the advertised offer in appearance due to availability at the time the prize is won. The offer images used are for advertising purposes only.
Should a winner of a prize request a cash alternative rather than the actual prize, InkRed reserve the right to deny this request and if the winner does not accept the prize, the prize claim will be deemed void. In this case and at their discretion, InkRed may offer a cash alternative which is not negotiable and may not be the market value of the prize. In cases where an agreement is reached regarding a cash alternative, the winner is still obliged to participate in relevant promotional activities which will promote the fact that they won the prize and not cash.
In the event that the exact model or match of a prize described in an advertisement for the Quiz is no longer available by the time the winner’s claim has been processed and details verified, we reserve the right to substitute the prize with another prize of similar model with the same or greater value. In the event that the prize is a motor vehicle and the winner is a resident outside ROI or outside the country that the prize is being advertised in, InkRed reserve the right to substitute the motor vehicle with cash. Any cash substitution will be at an amount no greater than the ROI market price or the market price in the country where the prize is being offered, at InkRed’s discretion.
Dates of travel and accommodation are subject to availability; all additional costs incurred such as amendments to a booking after the booking has taken place, airport taxes, costs incurred from delayed or cancelled travel, transfers, hotel food and beverage extras are the responsibilities of the winner.
Cash items will be paid by InkRed and are subject to all applicable taxes and/or foreign duties on cash payments. All such taxes and/or foreign duties are the responsibility of the winner.
Where prizes that involve travel or the use of a vehicle, winners must hold a valid passport or relevant license to avail of the prize.
Unless specifically stated, Motor Vehicle prizes do not include insurance or any applicable taxes on or in respect of purchase or any import or export duties and any such insurance, duties, taxes, delivery costs or other costs are the responsibilities of the winner. Where stated, motor vehicle insurance on offer will not exceed a maximum premium of €2,000 and is not redeemable for cash. Motor Tax is also not redeemable for cash.
Additional Offers and Promotions
From time to time, Inkred may offer additional incentives, offers and or promotions to new participants – now referred to as ‘offers’. If an advertisement presents an offer to new participants, upon joining Prizeclub you will be entitled to claim that offer. Only one claim per mobile number.
To claim, simply follow the instructions on the wap link that you will receive on your mobile. You must be a Prizeclub member for a minimum of 7 (seven) days in order to claim your offer. On the 7th day or thereafter, you must go to the appropriate claim section of the wap site and follow the process. It is your responsibility to claim your offer, it is not automatically assigned. Offers are non transferrable and may not be exchanged for cash. Mobile Phone Authentication
If you attempt to claim any prizes whilst not in possession of the active SIM card of the mobile phone that you played the Quiz with, your claim may not be processed unless you can produce sufficient documentation proving your association to the mobile phone as outlined below.
Winner using a Pre-Paid Mobile Phone-
We may require 2 forms of Identification, one being a passport or driving license and a utility bill confirming your address.
You may be required to present the SIM card of the mobile phone that you have used to play and win.
You may also be required to provide a letter from the mobile network confirming that you are registered against the mobile phone in question. If you have not registered the mobile with your network you must do so before a claim will be processed.
If the mobile phone used to play and win is not registered in your name, but another persons, you may be required to present a written statement from that person clearly stating that you were authorised to use the phone to participate in the Quiz.
Winner using Post-Paid/Billed Mobile Phone
We may require 2 forms of Identification, one being a passport or driving license and a utility bill confirming your address.
Present phone bill in the same name of ID.
You may be required to present the SIM card of the mobile phone that you have used to play and win with.
If the mobile phone used to play and win is not registered in your name, but another persons, you may be required to present a written statement from that person clearly stating that you were authorised to use the phone to participate in the Quiz.
Winner using Credit/Debit Card as means of payment-
We will require 2 forms of Identification, one being a passport or driving license and a utility bill confirming your address.
We will require a bill copy of the Credit/Debit Card used to play the Quiz.
You will be required to present the SIM card of the mobile phone that you have used to play and win with The InkRed Quiz.
If the mobile phone used to play and win is not in your name, you will be required to present a written statement from the bill-payer clearly stating that you were authorised to play the Quiz on their mobile phone.
If the Credit/Debit card used to play enabling you to win is not in your name, you will be required to present a written statement from the bill-payer clearly stating that you were authorised to play the Quiz using their Credit/Debit card.
Winners and Prize Fulfillment
Winners are chosen randomly by an independent body from those entrants who have correctly answered a question during the open times of an offer.
All winners will be required to return an acceptance form within an allocated timeframe in order to claim their prize. They will also be required to return a photograph as part of this acceptance form. If this form is not returned complete in the required timeframe, the prize will be forfeited.
The acceptance form may be sent via email or post, at InkRed’s discretion. It is the player’s responsibility to ensure they have access to email in order to claim a prize.
Winners agree to allow InkRed to publish their details and photograph and agree to partake in any reasonable related press or media promotions. Winners must provide these details on request in order to claim any prize.
When a winner is chosen and contacted, unless the winner specifies that they do not wish to claim the prize immediately, in which case an alternative winner will be chosen, their details may be published. Consent is not required as it is a condition of playing the game.
For prizes where there is an option to choose a preferred prize, winners will be required to choose their prize and return their acceptance form with photo and via the preferred method, within 7 days of notification. If not, the prize will be forfeited.
Where travel prizes are concerned and there is a choice of prize, winners must travel within 90 days of the closing date of the competition.
Notification may be by email, telephone, by post, via SMS, or by voicemail, or another appropriate means of communication. If a winner fails to return contact within the following timeframes or fails to provide any additional information requested outlined below including a photograph for promotional purposes, the winner will forfeit their claim to the prize and another winner will be chosen.
Prizes where there is a choice and are not time dependent:
- Winners will be contacted within 7 (seven) days of closing date.
- Winners must choose prize and return completed acceptance form with photo within 7 (seven) days.
- If a winner is chosen and InkRed fail to contact that winner within a period of 24 hours, the winner will have forfeited their prize and another winner will be chosen.
Prizes where there is no choice and the prize is time dependent such as an event or a ticket:
- Winners will be contacted the day after the closing date of the competition, or within a sufficient timeframe in order to deliver the prize to the winner and for them to avail of the prize.
- If a chosen winner is not contactable within 1 (one) hour, the winner will have forfeited their prize and another winner will be chosen and so on, until a chosen winner is successfully contacted.
- Winners must then return a completed acceptance form with photo by 10am the next day. Failure to do so will result in the winner forfeiting the prize and another winner will be chosen.
InkRed will make at least one phone call to chosen winners. At their discretion, InkRed may or may not make several phone calls, leave voicemails or use any method deemed necessary at the time to contact a winner in the allotted timeframe.
InkRed will endeavour to contact the winners within the allotted timeframe but shall hold no responsibility if the winner cannot be contacted and as a result, forfeit their prize and have no claim.
InkRed shall attempt to deliver all prizes that are not time dependent, travel prizes or motor vehicles, to winners within 28 working days from the date InkRed receive a completed acceptance form. Delivery times on the aforementioned prize categories may vary due to availability or organisational restrictions with winners. InkRed will at all times endeavour to deliver the prizes as soon as possible. Time dependent prizes will be dispatched within a suitable time frame.
InkRed will not be held responsible for any third party who is contracted to deliver a prize and fails to do so in the timeframe that they have been contracted to deliver within.
Prizes may not include reimbursement of any expenses incurred by the winner in connection with receiving the prize.
All winners may be required to meet with a InkRed representative at a location nominated by InkRed and the winner’s photograph will be taken for media purposes.
All cash prizes will be paid in Euro cheque or in the currency relevant to the region.
The recommended retail price of a prize may be stated as part of an advertisement for the Quiz. InkRed will endeavour to ensure that this information is as accurate as possible but cannot guarantee or does not claim that the prize is not available to purchase from a retailer at a lower or higher price.
